The New Jersey Department of Environmental Protection (NJDEP) is standing up a new statewide scrap tire management program under P.L. 2025, c.389, enacted January 20, 2026. The law establishes a scrap tire hauler licensing program and a manifest system to track scrap tires from generation through final disposition. NJDEP is rolling this out in phases and some requirements are already in effect.
Under the law, a “scrap tire” is defined as:

A tire no longer prudent or practical for vehicular use, or
-
A tire that hasn’t been used on a vehicle for more than six months since its last use.
What’s Required Right Now
 1) Temporary Scrap Tire Hauler Registration Form: Any entity that collects and transports scrap tires in NJ (to disposal, recycling, storage, reuse, or resale destinations) must complete and submit this form to [email protected]. This is not a license and does not replace the formal licensing system NJDEP is still developing, it’s a registration/data-gathering step.
2) Interim Scrap Tire Manifest Form: Haulers must begin tracking every load, regardless of quantity, immediately. Required details include origin of the load (contact, business, address, phone), quantity of tires hauled, date of transport, and receiving facility information. Manifests must be submitted monthly, no later than the 20th, and haulers must retain all completed manifests on file.
3) Retailer Obligations: Retailers and other businesses that hand off scrap tires must confirm their hauler has completed registration and can show proof of confirmation. Until further notice, maintain standard business operations while DEP develops guidance and implements the new statutory requirements. In other words, DEP is not currently directing facilities to refuse loads from transporters that have not yet completed the registration process. DEP’s current focus is on assisting the regulated community with coming into compliance while the program is being implemented.
What’s Coming Later
NJDEP has indicated that formal hauler licensing, electronic manifesting, and additional tracking/legal requirements are still under development and will be phased in over time. Registered haulers and stakeholders who submit contact information will be notified directly as these next steps roll out.
Action Checklist for Members

Determine whether your operation collects, transports, or receives scrap tires in New Jersey. This may include retread plants, casing pickups, or scrap disposal runs.

If you or a contracted hauler transport scrap tires, submit the Temporary Hauler Registration Form to NJDEP.

Begin completing the Interim Manifest Form for every load, effective immediately.

If you use third-party haulers, confirm they are registered with NJDEP and can provide proof.

Retain manifest records on file per NJDEP’s recordkeeping requirement.
