The House of Representatives approved H.R. 3441, the Save Local Business Act, legislation that would reestablish the “joint employer” standard that had been in place for more than thirty years and restore stability for job creators and employees.  NWRA President and CEO, Darrell Smith said, “On behalf of our members, I appreciate Congress passing H.R. 3441. We urge the Senate to take up this legislation and pass it quickly. It is a critical piece of legislation that removes uncertainties hindering business growth.” In August 2015, the National Labor Relations Board (NLRB) issued a decision in the Browning-Ferris Industries (BFI) case that overturned the long-held definition of joint employer, which deemed companies joint employers if they exercised “direct and immediate” control over primary elements of employment. The BFI case overturned that decision and replaced it with a standard that leaves employers and employees with no clear guidelines as to when a joint employment relationship exists.  H.R. 3441 would provide businesses with a more clear and concise understanding of their legal obligations, and it will fix a misguided policy by providing a smart and strategic solution to help businesses create jobs and increase economic growth.
