No solid waste management facility shall hereafter be constructed, allowed to commence operation or continue operation within the town. Those words make up Section VIII of Local Law No. 7 of 2016, known as the “Town of Seneca Falls Waste Disposal Law.”

Board member Annette Lutz introduced the measure at Tuesday’s Town Board meeting. Mary Sarratori seconded the motion. Lutz, Sarratori, David DeLelys and Vic Porretta approved it. Supervisor Greg Lazzaro was absent.
The measure is now subject to a public hearing that has yet to be scheduled.

Seneca Meadows would remain exempt from the local law under the current terms and conditions of its existing operating permit issued by the state. That permit expires Oct. 10, 2017. During public comment, Cooperstown attorney Doug Zamelis distributed copies of the proposed local law. Zamelis represents Waterloo Container, a company owned by the Lutz family that is across Route 414 from the landfill. “It is based on a local law I wrote for a town in Chautauqua County that was upheld by the courts,” Zamelis said. “Introduction of this local law would start the process. It’s not a zoning law and does not need to go the (Seneca County) Planning Board for review. You just need to schedule a public hearing.”

Zamelis received applause as he left the podium. Steve Churchill, D-Seneca Falls, a member of the county Board of Supervisors and chairman of its Environmental Affairs Committee, urged the board to follow Zamelis’ suggestions. “Introduce the local law and protect us,” Churchill said.
